Mooflet Terms of Service.

1. Acceptance of Terms

By downloading, installing, or using Mooflet ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Mooflet is a companion app for VanMoof Electrified S2/X2, S3/X3, S5/A5 and S6/S6 Open e-bikes, providing:

• Bike control: Lock/unlock, motor power, lights, bell, and speed settings via Bluetooth
• Ride tracking: GPS-based route recording with distance, speed, and duration
• Health integration: Automatic workout syncing to Apple Health (iOS) and Google Health Connect (Android)
• Music display: Currently playing track information during rides
• Bike dashboard: Battery level, odometer, firmware info, and bike settings

System requirements: iOS 16+ or Android 8+. Bluetooth Low Energy required for bike connection.

3. Eligibility

• You must be at least 13 years old to use the App
• Users under 18 require parental consent
• Users must be 18 or older to modify speed settings or use speed-related features

4. Account Requirements

• A valid VanMoof account is required to use Mooflet
• You must own or have authorized access to the VanMoof bike you connect
• You are responsible for maintaining the security of your VanMoof credentials
• Do not share your account credentials with others

5. Bike Control Features

• Lock/unlock: Remotely lock and unlock your bike via Bluetooth
• Motor power: Adjust motor assistance levels
• Lights: Control front and rear bike lights
• Bell: Trigger the electronic bell and change bell sounds
• Speed limit: View and modify the bike's speed limit setting

Only use bike control features on bikes you own or are authorized to use. Always prioritize physical safety over app functionality.

6. Speed Features Disclaimer

IMPORTANT LEGAL NOTICE:

• Adaptive Speed Mode (ASM): Adjusts motor assistance based on GPS speed. GPS accuracy may affect assistance levels.
• Regional speed settings: Mooflet allows selecting region-specific speed limits. You must select the setting appropriate for your jurisdiction.
• Legal responsibility: You are solely responsible for ensuring your bike's speed settings comply with local e-bike regulations
• Warranty: Modifying speed limits or motor settings may void your bike's warranty
• No endorsement: Mooflet does not endorse exceeding legal speed limits
• At your own risk: All speed modifications are used entirely at your own risk

7. Ride Tracking

• GPS-based: Ride tracking uses device GPS for route recording
• Auto-start/stop: Rides can be started and stopped automatically or manually
• Accuracy: Distance, speed, and route data are approximations based on GPS signal quality
• On-device: All ride data stays on your device and is never uploaded

8. Health Integration

• Apple Health (iOS): Completed rides can be saved as cycling workouts to Apple Health
• Google Health Connect (Android): Completed rides can be saved as cycling exercise sessions
• Estimated data: Calories, distance, and other metrics are estimates and should not be relied upon for medical purposes
• Permission required: Health integration requires explicit user permission and can be disabled at any time

9. Music Features

• Read-only: Mooflet reads currently playing track information from your device's music player
• No streaming: Mooflet does not stream, download, or store music
• Display only: Track info (title, artist, artwork) is displayed during rides for convenience

10. Certificates and Authentication

• Primary certificate: Generated from your VanMoof account for bike control
• Secondary certificate: Can be generated for sharing bike access
• Shared Keychain (iOS): Certificates are shared between Mooflet and Moofment via a shared Keychain group for seamless access
• Secure storage: All certificates and keys are stored in platform-specific secure enclaves (iOS Keychain / Android KeyStore)

11. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

• No warranty: We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• Battery accuracy: Battery level readings are approximations provided by the bike's hardware and may not reflect actual charge
• Odometer accuracy: Odometer readings are as reported by the bike and may differ from actual distance traveled
• Bluetooth reliability: Bike connection depends on Bluetooth signal strength, device compatibility, and environmental factors
• GPS accuracy: Location and speed data depend on GPS signal quality and may be inaccurate

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No liability: We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages
• Bike damage: Not liable for any damage to your bike resulting from use of the App
• Personal injury: Not liable for accidents, injuries, or incidents during rides or while using bike control features
• Data loss: Not liable for loss of ride data, settings, or credentials
• Speed modifications: Not liable for consequences of modifying speed settings, including fines, accidents, or warranty voiding

13. VanMoof Dependency

• Server dependency: Mooflet requires VanMoof's servers for initial authentication and certificate generation
• Server availability: If VanMoof's servers become unavailable, new sign-ins and certificate generation will not be possible
• Existing sessions: Already authenticated sessions and locally stored certificates will continue to work offline
• No guarantee: We cannot guarantee the continued availability of VanMoof's authentication services

14. Intellectual Property

• VanMoof trademark: "VanMoof" is a registered trademark of VanMoof B.V. Mooflet is not affiliated with, endorsed by, or connected to VanMoof B.V. or its successors
• App content: All code, design, and materials within Mooflet are owned by VanMoofer
• No reverse engineering: You may not reverse engineer, decompile, or disassemble the App

15. Governing Law

• Applicable law: These Terms are governed by the laws of Germany
• Jurisdiction: Disputes shall be resolved in the courts of Tübingen, Germany
• EU consumers: EU consumers retain the benefit of mandatory consumer protection provisions in their country of residence

16. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated "Last Updated" date. Continued use of Mooflet after changes constitutes acceptance of the updated Terms.
