Agreement to Terms
By downloading, installing, or using ColorFeel ("the App"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our App.
Description of Service
ColorFeel is a mood tracking and wellness iOS application that allows you to:
- Track your daily mood and emotional patterns
- View correlations with weather, health, and lifestyle factors
- Access AI-powered insights and personalized recommendations (Pro subscription)
- Visualize your emotional journey through beautiful charts and calendars
- Integrate with Apple Health for comprehensive wellness tracking
User Accounts and Data
ColorFeel does not require account creation. All your data is stored locally on your device. You are responsible for:
- Maintaining the security of your device
- Backing up your data if desired (via export feature)
- Any content you create within the app
Subscription Services
Free Tier
ColorFeel's core features are free to use, including:
- Unlimited mood logging
- Weather and health correlations
- Basic insights and visualizations
- Data deletion at any time
Premium (One-Time Purchase)
For $4.99 (one-time), Premium unlocks:
- Ad-free experience
- Data export (CSV)
- Premium color schemes
- Lifetime access to Premium features
Pro Subscription
Pro subscription provides AI-powered features:
- Monthly: $2.99/month
- Yearly: $19.99/year
- Includes all Premium features plus AI insights
BYOK (Bring Your Own Key) Subscription
For users who prefer to use their own API keys:
- Monthly: $1.99/month
- Yearly: $14.99/year
- Unlimited AI queries with your own API keys
- You are responsible for API costs from providers
Subscription Terms: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in your Apple ID settings.
AI Features and Limitations
AI-powered features are provided for informational purposes only:
- Not Medical Advice: AI insights are not a substitute for professional mental health care
- Accuracy: AI responses may not always be accurate or appropriate
- Data Sharing: By using AI features, you consent to sharing selected data with AI providers
- Usage Limits: Pro subscription includes monthly AI query limits
Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Attempt to reverse engineer or modify the App
- Abuse AI features by sending harmful or inappropriate content
- Resell or redistribute the App or its features
- Circumvent subscription or feature restrictions
Intellectual Property
The App and its original content, features, and functionality are owned by ACP (Aydin Can Polatkan) and are protected by international copyright, trademark, and other intellectual property laws.
Third-Party Services
ColorFeel integrates with third-party services:
- Apple WeatherKit: Subject to Apple's terms of service
- Apple HealthKit: Subject to Apple's Health guidelines
- AI Providers (Claude, ChatGPT, Gemini): Subject to their respective terms
- Google AdMob: Ads displayed in free version
Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:
- The App will be uninterrupted or error-free
- AI insights will be accurate or helpful
- Weather or health correlations reflect causation
- Data will never be lost (back up important data)
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or privacy breaches on your device
- Decisions made based on AI recommendations
- Mental health outcomes from using the App
- Third-party service interruptions
Health Disclaimer
Important: ColorFeel is a wellness tool, not a medical device. If you're experiencing mental health difficulties, please consult a qualified healthcare professional. In crisis situations, contact emergency services or a crisis helpline.
Termination
You may stop using ColorFeel at any time by deleting the app. We reserve the right to terminate or suspend access to AI features for users who violate these terms.
Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App.
Governing Law
These Terms shall be governed by the laws of the Netherlands, without regard to conflict of law provisions.
